Labour Day: questions frequently asked by clients

The CCQ's offices will be closed on September 6, 2021. – With the Labour Day holiday fast approaching, the Commission de la construction du Québec has been fielding a number of questions from construction workers and employers. Here are the answers to those questions.


WHEN ARE THE LABOUR DAY HOLIDAYS (AS PER THE 2021-2025 COLLECTIVE AGREEMENTS)?

The Labour Day holidays for the years 2021 to 2024 fall on:

  • Monday, September 6, 2021
  • Monday, September 5, 2022
  • Monday, September 4, 2023
  • Monday, September 2, 2024

AS AN EMPLOYER, CAN I MOVE THIS HOLIDAY TO ANOTHER DATE?

No, only the parties in charge of negotiating collective agreements can settle on dates other than those negotiated. However, an exception is made in the case of an employer assigning a security systems installer to maintenance and repair work.


MY EMPLOYER IS ASKING ME TO WORK ON THE STATUTORY HOLIDAY. CAN I FILE A GRIEVANCE WITH THE CCQ?

Yes, you can report the situation to the CCQ.


AS AN EMPLOYER, HOW SHOULD I BE PAYING FOR THIS STATUTORY HOLIDAY?

This statutory holiday is paid through the 5.5% statutory holiday pay provided for in the collective agreements.


IN THE RESIDENTIAL SECTOR, CAN EMPLOYEES BE PAID BY MEANS OF THEIR HOURS IN RESERVE TO MAKE UP FOR HOURS ON THAT DAY?

No. Reserve hours cannot be used to compensate for a statutory holiday.


CAN AN EMPLOYEE WORK ON THE LABOUR DAY STATUTORY HOLIDAY AND GET PAID OVERTIME?

All work performed on a statutory holiday is considered overtime.

AS AN EMPLOYER, CAN I REQUEST A WAIVER FROM THE CCQ FOR THIS STATUTORY HOLIDAY?

No, only the parties in charge of negotiating collective agreements can settle on dates other than those stipulated in the collective agreements. However, an exception is made in the case of an employer assigning a security systems installer to maintenance and repair work.

IS THE NORMAL WORK WEEK SHORTENED BY THE STATUTORY HOLIDAY?

Because of the holiday, the normal work week is shortened, with the following exceptions:


RESIDENTIAL INSTITUTIONAL AND COMMERCIAL
INDUSTRIAL CIVIL ENGINEERING AND ROADS
SHORTENED NORMAL WEEK Not applicable

All trades except: insulator, roofer, electrician, tinsmith, elevator mechanic, millwright, ironworker, pipefitter, fire protection mechanic, refrigeration mechanic, security systems installer, watchman.

For a compressed schedule in the institutional/commercial and industrial sectors, the work week is also shortened.

IS THE EMPLOYEE ENTITLED TO THE PAYMENT OF ROOM AND BOARD?

Yes, if the employee worked on the working day immediately before or after the statutory holiday.
