Infractions and types of proceeding

Depending on their nature, the infractions found by the Commission de la construction du Québec (CCQ) may lead to either civil or criminal proceedings.

Civil proceedings

In the case of civil proceedings, the CCQ itself brings suit in the courts. Usually, these are lawsuits on behalf of workers to collect money that has not been paid by employers (wages, vacation pay, etc.).

Criminal proceedings

For criminal cases, once the evidence is gathered, the CCQ recommends that the Directeur des poursuites criminelles et pénales bring suit. These cases are related to infractions against the Act respecting labour relations, vocational training and workforce management in the construction industry (Act R-20) and the related regulations.

The money collected from criminal cases is paid into the Fonds consolidé du revenu du Québec, and not to the CCQ.
