Pay for the first overtime hour at time-and-a-half: Comes into effect November 23, 2016

On November 23, 2016, the new general rule providing for pay for the first overtime hour of the week at time-and-a-half (50%) in the institutional and commercial and industrial (IC-I) sectors comes into effect. All subsequent overtime hours will continue to be paid at double-time (100%).

The date that this new provision comes into effect was determined by the Association de la construction du Québec (ACQ) and the Alliance syndicale, as required by arbitrator François Hamelin in his decision of September 24. This file had been submitted to a board of arbitration following an agreement in principle concluded between the ACQ and the Alliance syndicale for the IC-I sectors in July 2014.

Exceptions

The arbitrator’s decision provides some exclusions to the new rule. The parties also agreed that certain specific rules in the collective agreements would remain applicable as they already grant overtime hours paid at time-and-a-half or double-time in the first hour. Here are the exclusions:

  • Shutdown work in heavy industry, including work on isolated sites and in the Baie-James territory
  • Work at a premium rate done on Sundays
  • Work at a premium rate done on statutory holidays
  • Work covered by the special rule for the trade of elevator mechanic (article 21.03 1))
  • Work covered by the special rule for the trade of erector mechanic (glazier) (article 21.03 2)
  • Work done on isolated sites, in the Baie-James territory, and on construction projects north of the 55th parallel, including the Grande-Baleine project (article 21.03 3, institutional and commercial sector)
  • Work done on isolated sites, in the Baie-James territory (article 21.03 3, industrial sector)
  • Work covered by the special rule for the trade of security systems installer
    (article 21.03 6).
